  • It's also the nature of software development. If someone comes out with a Cool Thing™, then other companies/programmers can reproduce it on their own and incorporate it into their product.

    That's why patents remain popular with software. They serve as a deterrent and protection against other companies/people taking your idea and stealing your market from you. I don't really want to start a flamewar on patents (there are plenty of examples of abuse) ... I'm just saying that if they were properly used, it could help keep things in check.
