Ok - I have thought about the possibility that two brothers are adopted and originally had the same parents but are now not legally related as brothers. This doesn't make them not biological brothers.

I have also thought of the weird implimcations of surrogates, sex changes, and what not - but it seems that would be too complicated for the riddle.

So I am left with guessing that the riddle is worded the way it is because we are assuming things that are not true.
